A Non-Attribution-Dilemma and its Impact on Legal Regulation and other Rational Strategies by Michael Niekamp and Florian Grunert

Abstract:

A general challenge of cyberwar lies in the field of legal regulation. This paper analyses the systematic role of the nonattribution-problem with regard to the possibility of rational legal regulation. Firstly we provide a conceptual specification of nonattribution. Secondly, referring to a classical definition of war and a sound principle of self-defense, we provide a logical clarification of these terms for cases of non-attribution. Afterwards we argue that any attempt to rational legal regulation will lead to a serious non-attribution-dilemma, which consists either in a reductio ad absurdum of the category of war and a sound principle of self-defense or the indistinguishability of a state of regulation and anarchy. However, the existence of this non-attribution-dilemma has no impact on the possibility of rational deterrence through a threat of retaliation, which in turn might lead to a complete prudential dilemma. When you look at the slide above you realize that a change of view gives cybernetic war a totally new draft for research. We know that a lot of strange things were published about this topic. Cybernetic war was treated by the media as mysterious riddle which also influenced the leaders in the world. You can understand this slide when you look at the term cyberwar. The term cyberwar is a buzzword of cybernetics and war. You can analyse this two words and out of that you will understand why all the hype was totally irrational:
First the word cybernetic:
Until today the ideas of cybernetics of the early 1950 influenced society and espically militaries. Militaries interconnected their weapons from land, sea, air and space. Cybernetic space influences war until today. The implications for militaries are a massive shift in their strategy. On the next slides we will publish some theoretical implications for the future army. Second the word war:
Cybernetic is new constant in war but we should recognize our old defintions of war. Without this discussion it will be confusing and it will be difficult to create a term which can be used for law and sciences.
